Welcome to Echophoria! These Terms of Service ("Terms") govern your use of the Echophoria mobile application ("App") provided by Echophoria ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using Echophoria, you confirm that you are at least 8 years old (with parental consent if under 18) and agree to comply with these Terms. If you do not agree, please do not use the App.

2. Description of Service

Echophoria is a presentation skills training app that provides:

• Video recording of practice presentations
• AI-powered analysis of speaking skills
• Personalized feedback and improvement exercises
• Progress tracking and gamification features

3. Account Registration

You may create an account using Apple Sign-In or continue as a guest. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Subscription and Payments

Payment Terms:

• Subscriptions are billed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your Apple ID account settings
• No refunds are provided for partial subscription periods

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Upload content that infringes on others' rights
• Attempt to reverse engineer or modify the App
• Share your account credentials with others
• Use the App to create harmful or offensive content

6. Content and Recordings

Your Content: You retain ownership of all video recordings and content you create. By using the App, you grant us a limited license to process your audio for analysis purposes.

Our Content: All App content, including exercises, prompts, and feedback algorithms, is owned by Echophoria and protected by intellectual property laws.

9. Intellectual Property

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR SPECIFIC REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHOPHORIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

You agree to indemnify and hold harmless Echophoria from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. Upon termination, your right to use the App will immediately cease.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
